1. Our Privacy Policy
In this ‘Privacy Policy’, ‘Memble’ 'us' 'we' or 'our' means Memble Pty Ltd (ACN 626 272 722) trading as Memble. We are committed to respecting your privacy and understand your need for security and confidentiality. Our Privacy Policy sets out how we collect, use, store and disclose your ‘Personal Information’. By using our website and the Memble mobile applications (collectively the “Memble Platform”), you confirm you have agreed to the Terms and Conditions and read and understood this Privacy Policy.
2. Some key terms
In our Privacy Policy, when we refer to “End User”, we mean the customers who use the Memble Platform through your Business User account. Any other capitalised terms not defined in this Privacy Policy have the meanings in our Terms and Conditions.
3. How does this Privacy Policy apply?
This Privacy Policy describes what we do with personal information that we collect and use for our own purposes, such as your account information and information about how you use and interact with the Memble Platform, including information relating to your End Users.
4. What Personal Information do we collect
The term ‘Personal Information’ encompasses a broad range of information.
A number of different types of information are explicitly recognised as constituting Personal Information under the Privacy Act 1988 (Cth) (Privacy Act). For example, where we refer to ‘Personal Information’, this means information which identifies an individual or from which an individual's identity can be reasonably ascertained. In some circumstances, including where it is necessary for the conduct of Your Services, we may need to collect sensitive information. Sensitive information is defined in the Privacy Act and includes information or opinion about an individual’s racial or ethnic origin, political opinion, religious beliefs, sexual orientation or criminal record, provided the information or opinion otherwise meets the definition of Personal Information) (Personal Information).
5. How we collect personal information
We obtain Personal Information from various sources. We do this in three main ways:
1. You provide some of it directly (such as by registering for a membership).
2. We record some of it automatically when you use the Memble Platform (including with technologies like cookies).
3. We receive some of it from third parties (for example when you make payments to us using our payment processor ‘Stripe’).
We may also obtain Personal Information from you using your Memble card, QR Code, number or associated identifiers, making a purchase with a Merchant or Channel Partner, placing an order online, making a non-cash payment, participating in a promotion, competition, or survey, registering for services, using related digital services, submitting a form or subscribing to any of our newsletters or updates in relation to any part of the Memble Platform. We may monitor and record your communications with us (including email and telephone) for security, dispute resolution, and training purposes.
If you sign up as a Business User we obtain limited information about your payment card from Stripe, such as the last four digits, the country of issuance and the expiration date. Stripe uses and processes your complete payment information in accordance with Stripes’ privacy policy.
6. End Users’ personal information
Our customers who have created Business User accounts are responsible for what they do with the personal information they collect, directly or through the Memble Platform, about their End Users. This Section 6 is directed to such customers.
(a) Your relationship with End Users
If you are a Business User, you may collect personal information about your End Users. For example, during the creation of events you may ask your End Users to provide their name, address, email address and payment information so that you can complete their membership. You may also use cookies and similar technologies to analyse usage and other trends.
You are solely responsible for complying with any laws and regulations that apply to your collection and use of your End Users’ information, including personal information you collect about them from us or using the Memble Platforms functionalities, cookies or similar technologies.
You must publish your own privacy and cookie policies and comply with them.
We are not liable for your relationship with your End Users or how you collect and use personal information about them (even if you collect it from us or using the Memble Platform functionalities or cookies or similar technologies) and we will not provide you with any legal advice regarding such matters.
(b) End User payment information
Your End Users’ payment information may be processed via Stripe with which you integrate your account. This is to be in accordance with our Terms and Conditions and Stripes terms and policies. We transmit your End Users’ complete payment information when they initially provide or update it only so that we can pass it along to Stripe. We do not collect or store your End Users’ payment information.
7. To whom do we disclose your Personal Information?
In certain circumstances, we may provide some of your personal information to a third party to assist with the provision of our services.
In limited other circumstances we may be required or authorised by law to provide your personal information to third parties, such as law enforcement agencies. We may disclose personal information where you have consented, or where disclosure is necessary to achieve the purpose for which it was submitted.
We also use third party service providers who may store or process your personal information outside of Australia. If you provide your Personal Information to us, you consent to the disclosure of your information outside of Australia and acknowledge that we are not required to ensure that overseas recipients handle that Personal Information in compliance with the Australian Privacy Law. We will, however, take reasonable steps to ensure that any overseas recipient will deal with such Personal Information in a way that is consistent with the Australian Privacy Principles.
8. Using our website and cookies
We may collect Personal Information about you when you use and access the Memble Platform.
While we do not use browsing information to identify you personally, we may record certain information about your use of the Memble Platform, such as which pages you visit, your memberships, events you create or attend, and the internet protocol address assigned to your computer.
We may also use 'cookies' or other similar tracking technologies on the Memble Platform that help us track your usage and remember your preferences. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your web browser that enables the sites or service providers systems to recognise your browser and capture and remember certain information. We use cookies to help us remember and process the status of your account, understand and save your preferences for future visits, keep track of advertisements and compile aggregate data about site traffic and site interaction so that we can offer better and individualised site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.
Other technologies that may be used with the Memble Platform include web beacons (which may operate in conjunction with cookies) and JavaScript. You can configure your web browser to reject and delete cookies and block JavaScript, but you may find some parts of the Memble Platform then have limited functionality.
Our systems record a variety of information in relation to interactions with the Memble Platform. This can include information about software versions used, device types, device identifiers (like IP address), location data (where available and not disabled by the user), dates, times, file metadata, referring website, data entered, and user activity such as links clicked.
We may also use cookies to enable us to collect data that may include Personal Information. For example, where a cookie is linked to your account, it will be considered Personal Information under the Privacy Act. We will handle any Personal Information collected by cookies in the same way that we handle all other Personal Information as described in this Privacy Policy.
9. Links
The Memble Platform may have links to other websites, provided for your convenience and information. Memble is not responsible for the content on these sites and no endorsement or association is implied. We are not responsible for the privacy practices employed by websites or services that we link to from the Memble Platform, including the information and content contained therein. When you click on these links you are moving to another website and service and our privacy policy and terms and conditions do not apply to third party services and websites. Please review their policies for how they collect, manage and use your browsing and interactions and your personal data.
10. Security
We may hold your Personal Information in either electronic or hard copy form. We take reasonable steps to store your Personal Information securely and to protect your Personal Information from misuse, interference and loss, as well as unauthorised access, modification or disclosure and we use a number of physical, administrative, personnel and technical measures to protect your Personal Information. Personal Information that is held and stored by us is protected from unauthorised access through the use of firewalls, secure passwords and login processes.
We implement a variety of security measures to maintain the safety of your personal information when you place an order or access your Personal Information. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via 128 bit Secure Socket Layer (SSL) technology and then encrypted into Stripes database only to be accessible by those authorised with special access rights to such systems, and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers. However, we cannot fully guarantee the security of your Personal Information.
11. Changes to this Privacy Policy
We may make changes to this Privacy Policy from time to time by publishing an updated Privacy Policy on the Memble Platform. Unless we have obtained your prior consent, we will not use the personal information that you have submitted to us under this Privacy Policy in any manner which is not consistent with this Privacy Policy.
